Gilbert Martinez and, "The American Holocaust"
I want you to take a few seconds and try to remember where or what you were doing 33 years ago. Picture it. Remember it. Yes, I know, it was a long time ago. That is my point. 33 years is a hell of a long time ago.
Over the years I have repeatedly drawn attention to the CRIMES committed against both citizen and non-citizen by the American Justice System - from President to pauper, none are safe.
I have illustrated, as best I can with my limited resources, the unchecked violations of the law by State and Federal Prosecutors who withhold information, who fabricate testimony, who coerce witnesses to enhance or even lie, and then reward these lies by bribery of sentence reductions or even release from prison. This evil is seldom if ever punished - even when said Prosecutors are caught ted-handed. Reality is: Prosecutors by any stripe are seldom held accountable for their own dirty deeds.
I have spoken to you of "Ghost Dope"; a manufactured, imagined amount of drugs based upon the "word" of a person who through inflating the numbers, the amount of drugs bought and sold, makes himself more valuable as an Informant by overstating the activities and the STATUS of the person he/she is informing on, ie. the bigger the fish, the bigger the reward.
Look. Snitches/Informants are notorious self-serving individuals who profit from lies. There has NEVER been an Informant who showed up at the police station to confess to being a drug dealer out of the goodness of his heart. There is ALWAYS a self-serving reason for their cooperation - always. Informants are MADE liars by a system of bad laws which offers rewards of less-time in prison or even no-time in prison - as long as they help the police to catch others. Just ask yourself this fair question: if you were caught with enough drugs to get yourself a 20 year prison sentence and you could pin it on someone else and do 10 years instead, or if your story was big enough, no time, what would you do? Pretty obvious; and your an upstanding person ... imagine what a deviate would do. The answer is anything! And this all made possible by a set a bad laws which allow the Government to convict folks without physical evidence (Ghost Dope) and to Indict and prosecute folks with nothing more than the word of two or three people, often times other prisoners, who are willing to testify that you were involved in THEIR criminal activity (Conspiracy Laws). Unfortunately this is how the American Justice System is constructed. It works based on laws passed by uninformed politicians, and if you disagree with these laws you're labeled a Liberal, A Socialist, a Communist - an anti-American nut-job who's, "soft on crime". The "Ministry of Fear" used to control decent folks.
After 30 years of incarceration I have worked my way down from the US Penitentiary in Florence, Colorado to a Low Custody prison in Bastrop, Texas. Here at Bastrop I met a man named Gilbert Martinez from San Angelo, Texas. Nice guy. Hardworking, very respectful and he is immensely proud of his children. All good qualities.
I will admit that I have become reclusive; a hard man to get to know - just don't have a lot to say, lol, unless I'm preaching of course, then I can wear you out. However, Gilbert and I began to talk, he's a nice guy, not caught-up in the bullshit. In our conversation it came out that he had a 33 year sentence for, Drug trafficking's! 33 years! No. he didn't rape anyone or kill anyone - he was accused and convicted of trafficking's and selling, Methamphetamines' ... convicted? In reality he pleaded guilty and accepted this outrageous sentence of 33 years, as opposed to the "LIFE" sentence they were going to give him if he exercised his right as an American to a trial by his peers (his attorney suggested that the "facts" about the amount of Meth bought and sold was was not relevant; the truth is not relevant; the jury is likely to believe the government and its INFORMANTS and that there was a high probability he would be found guilty ... 33 years in prison, or Life in prison. The fact that he was not caught with this Meth does not matter ... the truth, does not matter. Damn it man ... I hope and pray that you or your loved ones never, have to make this choice.
Here are the facts. Gilbert was guilty - to an extent. He was buying and selling Meth - this is true, that is not the argument here, the argument he had/has is that according to the actual amount of dope he was guilty of, he should have received a 10 year-or-less, sentence - not 33 or Life!
In his indictment, Gilbert, was accused of all kinds of drug trafficking's, all of which were based on two things: First, the testimony of folks trying to mitigate their own future or present prison sentences by turning Informant and or lying about their own culpabilities in the matter. Two of the Government witnesses were already in jail at the time - COME ON NOW - we all know that what they were after was a "Get Out Of Jail Free" card.
Yes, Gilbert is guilty of selling Meth. This is not the issue. This issue is not debatable. The issue is the 33 year prison sentence he was given. He was given this draconian sentence because one of the informants - the one ACTUALLY caught with the Meth AND a gun - said, "it wasn't me. I was only following instructions. I was working for Gilbert". And that my friend is all it takes. However, he's the real bad guy! Good guys don't carry Meth and a pistol around in their car. Trust me here - he ain't the good guy.
On the streets its called, "Getting off first". This means, the first person to co-operate, to tell on everyone else gets "The Deal", his/her word and story become the narrative. The cops are going to build their case based on that testimony. And, as I have previously stated, the bigger the story, the bigger the prize, the better the deal - for the guy "Getting off first".
Gilbert is guilty ... but he was charged by the overstepping of the bounds of truth concerning the amount of product he was actually involved with; he was convicted with Ghost Dope and a gun ... the gun the informant had, not him. He was, based on informant testimony, convicted of being a "King Pin" and made out to be, El Chapo.
In reality, Gilbert was a man who lived in a modest one bedroom apartment, who drove an old Chevy pickup-truck. He was not a rich drug lord, King Pin. He didn't have a big ranch or a Mercedes or a Rolex or any of the things a real Drug King Pin would have had. He was a small time drug dealer who became a King Pin on paper because of bad laws and the desire of Law Enforcement to pad their resume's.
10 years is a fair sentence for Gilbert.
33 years is a travesty.
How does this happen?
It happens because your Congressmen have passed laws which allow Prosecutors to Indict without evidence on the WORD of Informants (Conspiracy Laws), and for cops to arrest folks without evidence (Ghost Dope) and for Prosecutors to give favorable deals to anyone willing to testify, with incentives to lie ... AND people, this also happens because YOU, the American public, those who serve on JURIES, have had the wool pulled over your eyes by the media who constantly scares the shit out of you with daily reporting on the horrors of crime in America! I have stated time after time that IF you actually want to De-fund the Police by needing less of them, OR eliminate crime, then you have to eliminate the source of the money made from said crime ... to do this you do like they did in the 1920s when they eliminated the "Prohibition" on alcohol; the same Prohibition that made Al Capone and other "dealers" rich, is the same Prohibition that made El Chapo and a thousand others like him rich. Eliminate the War on Drugs! It has been a disastrous failure.
